Abstract: 

Introduction: The present study, based on the resistance discourse of inverted Orientalism, seeks to provide an understanding of the indigenous conditions of Iranian society in relation to the Rights of the Child. The purpose of this study is to compare the Rights of the Child in six different areas: "1) Laws and regulations in Iran; 2) Internal policies in three areas of governance, government and bureaucracy; 3) Iranian civil society; 4) Policies of the international community (international); 5) The religion of Islam; 6) Policies of the Islamic world as the main areas of determining the nature of Children's Rights. This comparison is to identify and extract the advantages and strengths of Children's Rights in Islam over other areas of Children's Rights. The questions of the present study are "Similarities and general differences in the Rights of the Child in the six different areas of law and regulation in Iran; Internal policies in three areas of governance, government and bureaucracy; Iranian civil society; Policies of the international community (international); The religion of Islam; the policies of the Islamic world; and " the positive points and advantages of Children's Rights in Islam over other areas". Method: By exploratory analysis, the six domestic and foreign areas that are the basis of the definition of Children's Rights in Iran are based on Iranian laws and regulations; Internal policies in three areas of governance, government and bureaucracy; Iranian civil society; Policies of the International Community (International); and The religion of Islam. According to the foundation, we have identified the policies of the Islamic world and then analyzed them with the method of qualitative content analysis. Results and discussion: Due to its traditional and Islamic conditions, Iranian society considers the Child within the family and under the guardianship of parents or guardians to support the Child with the priority of collective interests in the family and society. According to this principle, the Child has the right to life in the family, even if it is not more than fertilization. The observance of this right is something beyond generation and beyond history, which includes previous generations. The Child has the right to independence, non-colonialism and non-sanction in a larger or more structured community such as society. Conclusion: Children of Islamic societies, including Iran, need the Rights that are not considered by the central societies like the Convention on the Rights of the Child as the dominant global sources, as if the Rights of the Child presented in global sources, separate reading and miles. It is far from the social and cultural contexts of the surrounding communities (including Islamic and Iranian). This issue requires the attention and action of the surrounding communities in order to provide an "indigenous structure of Child Rights. "

Abstract: 

The most important manifestation of any society is the situation of Children in that society. When the legal structure of a society is ambiguous, unknown, incoherent, minimal or separate from the social and cultural context of that society throughout history, it indicates the unfavorable situation of Children in that society. At the macro level, it indicates the lack of focus of society on sustainable human development and can be a warning to managers and policy makers of that society in relation to the progress and development of society. The present study seeks to study the scientific structures and implementation of Children's Rights in Iran,The aim of the researcher was to identify the scientific and executive strengths and weaknesses related to Children's Rights in Iran. The level of research analysis is macro and structural,In this way, all programs, measures and structures related to the Rights of the Child in Iran are identified and then examined and analyzed using the monograph method and techniques of comparative, structural analysis, documentary analysis, expression of observations and experiences. Taken. The results show that: Conflict and disorganization in the definition of "Child" and "Childhood" in Iran, Lack of a specific national body for prescribing and policy-making, Denial system of the bodies in charge of protection programs Children, The gap between the definitions of different institutions, including the institution of religion, law and law, and also The non-compliance of any of the defined legal materials with the popular culture and historical memory of the Iranian society, leads to obstacles in improving the legal status. Abstract: 

Human Rights Council Advisory Committee is a consultative body of the Human Rights Council that provides the council's requested consultations. Its studies and reports lead to draft some international instruments. It is important to recognize the advisory Committee to understand the mechanisms of the UN system for protecting human Rights. The present study was designed to identify the advisory Committee and examine and review its function and role. This research has shown that the Advisory Committee has an international advisory role and it issues recommendations. Another function of the advisory Committee is providing suitable area to interact, exchange ideas, debate, and dialogue between experts of the Advisory Committee and representatives of governments and NGOs about human Rights issues. The Advisory Committee protects and promotes human Rights through shaping public opinion, informing and increasing knowledge and information production on various human Rights issues through studies, preparing reports, and drafting some international instruments. The Advisory Committee has strengthened the functions and efficiency of Human Rights Council.

Abstract: 

MDG 5-Improve Maternal Health-set a target of reducing maternal mortality by three-fourths by 2015. In 2007, the world's leaders added a second target under MDG 5: achieve universal access to reproductive health. Reproductive health is essential for reaching all other Millennium Development Goals. This shows why decision makers should priorities saving mothers' lives and key investments they should make in order to achieve that goal. Gender inequality, unfair health systems, disproportionately distribution of workforce, incorrect policy making, considering low priority for health in comparison to other systems, inequitable distribution of resources and inequity in financing that ignore minorities and marginalized population, are effective social determinants of Maternal Mortality.

Abstract: 

Since the inception of the UN human Rights monitoring system, periodic reports have always been considered as the most common monitoring instrument. This was mainly due to the fact that the said mechanism was thought to be a non-aggressive one, as contrasted to the individual complaints which affect the sovereign Rights of States. Over time, human Rights monitoring bodies, including the Human Rights Committee, have attempted to increase the efficiency of the periodic reporting mechanism through various means. The present article studies the measures taken by the Human Rights Committee in recent years, particularly in 2009 and 2010, with a view to strengthening the reporting system.

Abstract: 

Child adoption in Iran has always been directly related with the religious beliefs of the society and has had a particular importance since the ancient times up to now. According to the civil law of the society, those Children are competent to be adopted whose parents are not identifiable and they cannot return to the warm bosom of their families. One of the most significant and first Rights of the orphans and the Children suffering from bad parenting as a citizen is their identification and giving their custody and tutelage to individuals who are materially and spiritually competent to protect these Children. These Children either do not have any parents or their parents are not known or are not competent enough to raise the Child. Thus, judicial authorities under the supervision of social institutions give their protectorship to individuals or families whose competency has been already proven based on the social rules and laws. In this study using a descriptive-analytic method we have conducted a research on the citizenship Rights of the orphans and the Children who are suffering from bad parenting as well as the obligations and duties of the society and Child adopters on them according to the legal codes of Iran and Islam resorting to the existing databases and library documents.

Abstract: 

The crime of Enforced Disappearance is widely spread in the international arena. But because the lack of explicit codification of this crime, it still has a lot of gaps, and as a result, legal texts have not been clearly addressed it. However, the history of committing such acts has constituted a significant amount of international criminal law documents that principles and rules of law can extract from this documents and judiciary concern to this Crime. The main discussed topic is the responsibility of states to prevent the crime of Enforced Disappearance that emerged in the cases cited by United Nations Human Rights Committee under international Civil and Political Covenant. In the present paper, with focus on the judiciary, we have been discuses about this responsibility to States, which are sometimes undercover and not Specified in practical procedures. Abstract: 

The “ United Nations Commission on Human Rights” was principal body within the United Nations system responsible for strengthening the promotion and protection of human Rights. It was assisted in this work by the “ Sub-Commission on the Promotion and Protection of Human Rights” . Originally the 'Sub Commission on Prevention of Discrimination and Protection of Minorities', it was renamed in 1999. The Sub-Commission's main functions were to undertake studies and to make recommendations on human Rights issues and to carry out any other functions which may be entrusted to it. After The Human Rights Council replaced the former United Nations Commission on Human Rights, the Council adopted its "Institution-building package" to guide its work and set up its procedures and mechanisms. Among them was the “ Advisory Committee ” . It has been replaced the former Sub-Commission on the Promotion and Protection of Human Rights. The Advisory Committee provides to the Human Rights Council expertise and advice on thematic human Rights issues. This article was designed to compares the two institutions and their function and role to protect and promote of human Rights and realization UN’ s goals in the files of human Rights.

Abstract: 

Cyberspace provides a unique opportunity for Children to understand the right to freedom of expression and information. Child access to cyberspace is, therefore, a human right, which enables countries that are party to the Convention on the Rights of the Child to create age-appropriate digital content to support Children in their capacity for development and to ensure that Children have access to a wide range of information, including information held by public bodies, on culture, sports, art, health, civil and political affairs‏. This article found that access to cyberspace and equal digital opportunities create their Rights, including Children's access to information and freedom of expression and thought, the right to digital education and literacy, cultural Rights and leisure and play, and implementing the protection document‏. It was found from Children and adolescents in cyberspace and other existing regulations with international documents that the Islamic Republic of Iran has not been able to provide more protection to Children by international documents in cyberspace protection laws.
